To offer a safe and secure shopping experience, Top End Distributing LLC dba Top End USA has established these online Policies for any user, viewer, or buyer at www.topendusa.com.

Note: Many parts are for off-road use only. As with any racing activity, there are risks when performing performance modifications. All installations are at the customers own risk. Top End Distributing LLC or www.topendusa.com holds no responsibility either implied or otherwise for mechanical, electrical or other failure when using after market products. Some items listed are illegal in many states and only for racing vehicles which may never be used on a public highway.

Conditions of USE
Your use of this site indicates your acceptance of these terms and conditions. Your placement of an order indicates your acceptance of these terms and conditions.

All content included on this site, such as text, graphics, logos, button icons, images, audio clips and software, is the property of Top End USA or its suppliers/manufactures and is protected by U.S. and international copyright laws. All trademarks, service marks, and trade names of and related to Top End USA are proprietary to Top End USA. All other trademarks not owned by Top End USA or its subsidiaries that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Top End USA. Product information such as text, logos, and/or images used to promote products and/or the sale of products have been provided to Top End USA along with permission to use directly from the supplier or manufacture. Any unauthorized use from other companies of the materials appearing on this site without written permission from the supplier and or manufacture may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties. Your receipt of an electronic order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Top End USA reserves the right at any time after receipt of your order to accept or decline your order for any reason. Top End USA reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item and adjust your invoice accordingly. Top End USA may require additional verifications or information before accepting any order. Once you have placed a online, phone order, or other type of order with Top End USA, you have entered in a contract to purchase and your credit card will be charged immediately. Orders DO NOT always ship the same day. Please allow 24 hours for your order to ship. If you need priority delivery then please contact us by phone for immediate attention.

Because Top End USA reserves the right to accept or decline your order for any reason, typographical, product photo, and/or pricing errors that may occur do not entitle a customer to receive something from those errors. Top End USA cannot be held responsible for honoring purchases caused by such errors and will simply take action to correct the error. These errors are not a misrepresentation of a product, business, manufacture, or sale, but a error which Top End USA’s responsibility is to correct the error.

User Submissions
The personal information you submit to Top End USA is protected by our privacy policy. To the extent there is an inconsistency between these Terms and the Privacy Policy, the Privacy Policy shall govern.

Your voluntary provision to Top End USA of your cell phone number and or email address represents your consent that Top End USA may contact you by SMS(SEE TERMS) , MMS or email messages, and your consent to receiving such communications for transactional, operational, or informational purposes. You understand and agree that text messages and email may be sent to you using automated technology. You may unsubscribe from receiving text messages from Top End USA at any time by replying `STOP` to text messages. If you need assistance, contact customer service at (480) 966-3040. If you unsubscribe from receiving text messages from Top End USA , you may continue to receive text messages for a short period while Top End USA processes your request(s). When you provide any phone number to Top End USA , you warrant that you are the current subscriber or authorized user of the phone number. If you change, forfeit, or deactivate the phone number you provided to Top End USA , you agree to notify us immediately. Failure to do so constitutes a material breach of these Terms.

By making a Submission, you agree that such Submission is non-confidential, non-proprietary, and may be disseminated or used by Top End USA . If you make a Submission, you automatically grant-or warrant that the owner of such content has expressly granted-Petco a royalty-free, perpetual, irrevocable, worldwide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the Submission in any media or medium, or any form, format, or forum now known or hereafter developed. Notwithstanding the foregoing, Petco is not required to use any Submission.

You are solely responsible for your Submission, the consequences of making a Submission, and your reliance on any Submissions. Top End USA is not responsible for the consequences of any Submission. Top End USA is not responsible for screening or monitoring Submissions made to the Services by users. If notified by a user of a Submission allegedly in violation of these Terms, Top End USA may investigate the allegation and determine in good faith and its sole discretion whether to remove such Submission. Top End USA will have no liability or responsibility to users for performance or nonperformance of such activities.

Ordering Procedure
If you order a product, your payment is processed immediately. We will notify you the status of the order and the product availability. If you choose to cancel an item that is not classified as special order, we will do our best to accommodate but do not guarantee cancelations after an order is placed.

Special Orders
Customer acknowledges that if this purchase contains a special order item, the provisions of this paragraph supersede any conflicting general terms of these terms and conditions.

Product(s) classified as special order cannot be cancelled or returned for any reason. By using our digital confirmation link you agree to all terms and conditions associated with our website and hold harmless Top End USA against all suits at law or in equity and from any and all damages, claims, and demands for personal injury or actual or alleged infringement of any United States or foreign intellectual property right and to defend any suit or actions which may be brought against Top End USA for such injury and/or any alleged infringement because of the manufacture and/or sale of the material covered thereby. All special ordered Products are subject to a cancellation fee of 100% of the purchase price if cancelled at any time after placed.

Cancellations
An order that has shipped from our location or a supplier can not be cancelled, these are classified as returns. Once your order has shipped restocking fees will only apply if they are applicable. Special order items, custom built items will not be able to be returned. For this reason it is extremely important to check your invoice or order form.

We cannot guarantee a cancellation request will be processed after an order has been placed. Due to variables in logistics there is a chance your order will ship after a cancellation request is made.

Shipping Rates
The Shipping Rates shown at time of checkout are estimates only. We encourage you to contact us for a special shipping quote. If there is an error in the shipping rate quoted we will contact you and let you know of the changes. International orders(Outside the USA) are not automatically processed as we may require additional information from you.

Returns
If a product is ordered and not wanted, the UNUSED/non special order item can be returned. Restocking fees may apply and inspection of the received return is necessary before confirmation of refund. This is dependent on the manufacture or vendor. Shipping is not refundable in either direction. Return request MUST be reported within 30 days of the shipped date. No items will be returnable after 30 days. All products shipped from the Top End USA warehouse are shipped via Fedex, UPS or Freight and require a signature when delivered. Some packages shipped directly from the manufacture or vendor may or may not require signatures for package release. Fedex, UPS, and DHL have package pick up locations if you are unable to sign for the package. If the package is returned to Top End USA or the manufacture/vendor, you will be responsible for the return shipping costs and restocking fees if applicable.

Top End USA DOES NOT REFUND SHIPPING CHARGES.

If you modify, install, or alter the item in any form, we cannot accept it as a return, will not cover any expenses related to the product or installation, and you maybe be required to purchase a replacement.

International Shipping
All international shipments may be subject to customs fees, import duties and taxes. Any charges associated with the importation of products purchased from Top End USA or our affiliates are the responsibility of the buyer. Any costs resulting from the refusal to import a product purchased through Top End USA or our affiliates may result in additional charges.

Payment Terms
Top End USA accepts Credit Cards, Paypal, Affirm, Amazon Pay, and Bank Transfers with appropriate billing and shipping addresses. Billing and Shipping information may need to be verified after your order is placed before capturing payment or processing your order. All orders must be paid in full at the time of purchase unless we contact you otherwise. Prices and shipping cost is subject to change anytime because of exchange rates, shipping costs, manufacturer price changes, etc.

Warranty
Any applicable warranty is applied directly by the manufacturer. Warranty claims must be facilitated by the manufacturer. Top End USA does not facilitate warranty claims and are not responsible for product failures or failures due to installation. Top End USA offers the option to purchase 3rd party warranty coverage provided by `extended warranty`. All warranty claims submitted with Extend Warranty are facilitated by Extend Warranty services.

Certain products are intended for race use only as suggested by the manufacture and must be installed and set up by professional service centers ONLY. As stated above we are not responsible for shipping cost other than by our own mistake of incorrect shipping. Any item that is altered or changed from its original state will not be able to be returned or receive warranty support.

By law, a dealership is not allowed to void a warranty based upon having aftermarket parts installed on a car. When you add an aftermarket part to the car, the aftermarket part will void the warranty of the stock part it is replacing.

***VR or AP Branded Item Warranty Terms & Conditions below. Please note we do not cover shipping to or from the customer. Products must be shipped back, inspected, where we then determine if the product needs to be repaired, replaced, or refunded if necessary.***

VR Forged Warranty Terms

Top End USA offers a limited 1 year warranty on factory applied finishes and center caps. Top End USA reserves the right to refuse warranty coverage of the finish due do neglect or abnormal road conditions. Top End USA offers a Limited Lifetime warranty on wheels determined to be structurally unsound because of a manufacturing defect that has been determined to make the wheel unsuitable for its intended use. Damages or issues found with a wheel that are not directly caused by a manufacturing defect are not covered under any warranty offered by Top End USA. Top End USA has the right to refuse Warranty coverage for:

Wheels mounted to vehicles is in excess of the load rating of the wheel.
Wheels that have been modified in ANY way
Acts of nature or misuse.
Top End USA does not offer Road Hazard protection. Top End USA will not cover any issues from the result of collisions, potholes or debris.

VR Tuned ECU Flash Terms

All software sales are final and non-refundable after 30 days. Top End USA provides unique software
calibrations for specific vehicle applications and is not liable for misuse or vehicle behavior due to installation error or mechanical issues. Top End USA will provide support for individuals, including remote diagnosis to determine next steps as we see fit. End-users are responsible for vehicle maintenance and integrity of any OEM or aftermarket parts installation. Software purchased by Top End USA is guaranteed to function as intended on the exact application it is provided for. Please Note this excludes and does not guarantee specific horsepower or TQ figures.

Top End USA will provide lifetime support to users that purchased directly from Top End USA or an authorized dealer.

Hardware:

Tuning Boxes – Top End USA offers a 5 year limited warranty on manufacturer defects on all Tuning Boxes under the VRTuned brand.
Flash Loaders and Tools – Top End USA offers a 1 year limited warranty on manufacturer defects on all Flash Loaders and Tools.
Damages or issues found that are not directly caused by a manufacturing defect are not covered under any warranty offered by Top End USA.
Top End USA reserves the right to refuse warranty coverage for the following reasons.

VR Bespoke Interior Accessories Warranty Terms

Top End USA offers a 1 year limited warranty from the delivery date against manufacturer defects on all
products and modification services facilitated by VR Bespoke. Damages or issues found that are not directly caused by a manufacturing defect are not covered under any warranty offered by Top End USA.

Top End USA reserves the right to refuse warranty coverage for:

Neglect / lack of maintenance
Improper use or installation
Wear and tear
Acts of Nature
VR Aero Warranty Terms

Top End USA Guarantees the fitment and quality of all products offered by VR Aero if used for the intended purpose and application. Issues found that are not directly caused by a manufacturing defect are not covered under any warranty offered by Top End USA. To qualify for warranty coverage all items must be inspected prior to accepting delivery. Any damage found during delivery inspection must be reported to the carrier before accepting delivery. If damages are reported after delivery no warranty or coverage will be offered.

Exclusions from the Guarantee:

Neglect
Misuse
Use of Gas hood/trunk lifts
Use of Oem hood latches
3 Clear coat blemishes less than 9mm in size
Imperfect weave
Top End USA offers a limited 6 month warranty on clear coat that covers against significant color change. Like Automotive paints and clear coat, slight fading and discoloration is natural, this warranty covers only extreme cases and is at the discretion of Top End USA. Top End USA reserves the right to refuse clear coat warranty caused by Neglect or Acts of Nature.

VR Performance Warranty Terms

Top End USA offers a 1 year limited warranty on (non titanium) products and a 90 day warranty on titanium products under the VR Performance brand which covers manufacturing defects that prevent the item from being used for its intended purpose and application. Damages or issues found that are not directly caused by a manufacturing defect are not covered under any warranty offered by Top End USA.

Top End USA reserves the right to refuse warranty coverage for the following reasons.

Misuse
Installation errors
Acts of Nature

Agency Power Warranty Terms

All Agency Power products come with a LIMITED 1 YEAR WARRANTY to the original purchaser. This covers manufacturing defects that prevent the item from being used for its intended purpose and application. Damages or issues found that are not directly caused by a manufacturing defect are not covered under any warranty offered by Top End USA.

Top End USA reserves the right to refuse warranty coverage for the following reasons.

Neglect
Misuse
Installation errors
Acts of Nature
Personal Opinion
Please note: In order for any claim to be submitted, proof of professional installation or its attempt must be provided. All Warranty claims must be submitted for review. If approved, an RMA number will be provided which MUST be included in the packaging. If not included your returned product will be refused. All return shipping costs to and from Top End USA are the responsibility of the customer or distributor initiating the warranty claim. If the product is determined to be covered under warranty Top End USA will repair the product within original spec, offer a replacement, or refund if needed to the original purchaser. Our warranty does not cover any labor, services, or related products to our product.
